Larsson & Scheuritzel P.C. sent a contingent of three attorneys to the International Council of Shopping Centers Law Conference, hosted in San Antonio, Texas from October 25 to October 28.
Bruce Ritter co-presented a seminar entitled “Changing Times, Changing Minds: Revisiting Prohibited Uses and Their Enforceability in the New Era of Non-Traditional Retail,” with preparation assistance from Corinne Higgins. Among other points, Bruce and his co-presenter emphasized the need for careful contract drafting to accommodate the ever-changing retail landscape. Importantly, old leases and Reciprocal Easement Agreements may not prohibit newer uses arising from the advent of internet retail sales nor permit traditional uses that may have evolved with the times.
Rich Slavin hosted a lively round table discussion on the topic of “Enforcing the First Class Shopping Standard.” Rich and attendees discussed the difficulties in interpreting the commonly used standard. Dovetailing with Bruce’s topic, the discussion also explored new or different uses that may now be appropriate in first-class shopping centers.
